In order to buy wine from us or use this website, you must adhere to these terms and conditions. By making a purchase through our site or registering with the website, you are agreeing to be bound by these terms.

Peckham Cellars reserves the right to change these Terms and Conditions at any time by updating this page.

1. Sales

We fully comply with our obligations under the Consumer Contracts Regulations 2013.

1.1 Availability – Wine is a product which is subject to change. Therefore, while every effort is made to supply the product ordered, there may be certain instances where we reserve the right to supply you an alternative wine of a comparable quality, at no greater cost to you.
1.2 Customer Satisfaction – If you are dissatisfied with our performance in any way, please contact us on 0207 207 0124 or email us at: hello@peckhamcellars.co.uk. We aim to deal with enquiries as soon as possible and we strive to keep you updated about the progress of your enquiry where possible until a resolution has been achieved.

2. Prices and Payment

2.1 All prices are quoted in Pounds Sterling and may be per bottle or per case,
depending on the product marked. The prices include Value Added Tax at the
current rate, unless otherwise specified. Delivery costs are additional.
2.2 We accept the following payment options: PayPal, GooglePay, ShopPay, Visa, Delta, Electron, Mastercard and American Express.
2.3 We make every effort to ensure that the prices and descriptions on each of our products are accurate. The price of the goods you choose will be shown on the checkout page of our website when you place your order. You will be charged for this amount. If we notice an error in pricing before accepting your order, we are not obligated to sell the goods to you at the price shown. We will let you know if this occurs as soon as possible to give you the option of reconfirming your order or cancelling it.
2.4 There will also be a delivery charge, as indicated on our website. We offer free local delivery via courier Packfleet, for orders over £50, Monday-Saturday to all London postcodes. For orders under £50, delivery costs £6.

2.5 For postcodes outside of London we offer a courier service via Parcelforce. For orders over £50, delivery is free. For orders under £50, delivery costs £6.

3. Age Restriction

3.1 We will not sell wine to anyone who is not aged 18 years or over. In placing an order with us, you are confirming that you are at least 18 years old.
3.2 If you’re purchasing wine as a gift, the recipient must also be at least 18 years old.
3.3 If our couriers are in any doubt about the age of the recipient on delivery, they will ask for ID. If the person receiving the delivery is not able to supply an appropriate ID, the courier will be unable to deliver the wine.
3.4 Once the wine has been delivered, in accordance with the original delivery
instructions, it is the recipient’s responsibility. This does not affect your right to a
replacement if it is stolen.

4. Security

4.1 We use a secure payment server which provides state-of-the-art encryption and secure socket layer (SSL) technology to protect your credit card information. We have security measures in place to protect our customer database and access to this database is completely restricted internally. However, it is your responsibility to ensure your password remains confidential and that it is not disclosed to a third party.

5. Cancellations

5.1 We do not offer refunds for products that are not faulty.
5.2 If your order is damaged, please send us a photo of the broken bottle and
packaging within 7 days of receiving your order and we will refund you the cost of the bottle and shipping costs.
5.3 If you believe that your bottle of wine is corked, please call us on 0207 207 0124 or email us at hello@peckhamcellars.co.uk and we will take the necessary steps to replace the item or credit you for the product.

6. Intellectual Property Rights

6.1 You agree and acknowledge that Peckham Cellars own or are licensed to use all copyright, database rights, trade marks and any other intellectual property rights on this website. We own or are licensed to the business of Peckhamcellars.co.uk, the structure, design and layout of this website, as well as the styles of our products.
6.2 You are entitled to use this website only in accordance with these Terms and Conditions. In order to use this site or any aspect of it in any other manner, you must obtain our written consent. This includes providing hypertext or other links to this website from their own website or a third party’s website without our permission.

7. Warranties

We warrant that all of the wines we sell are of satisfactory quality and fit for general purpose.

8. Limitation of Liability

8.1 Nothing included in these Terms and Conditions excludes Peckham Cellars from liability for personal injury or death caused by negligence.
8.2 We will not be held liable for any loss or damaged caused by us or our
employees, or agents in situations where:
i. loss or damage was not foreseeable by both parties where the contract was
formed;
ii. loss or damage was not caused by a breach on the part of the supplier;
iii. loss or damage relating to business and/or non-consumers
8.3 We will not be liable for any loss or damage caused by customers handling the wine, including spillages or breakages.
8.4 Please note the inherent risks and warnings:
i. Alcohol should only be consumed in moderation
ii. A case of wine is heavy so take care when lifting it.
iii. Red wine can cause staining if spilled, so extra care should be taken.
iv. Sparkling wines can be prone to a build up of gasses so extra care should be
taken when opening them.

9. Data Protection

9.1 By providing your details to Peckham Cellars on our website, you are consenting to us maintaining, recording and holding that information, as well as using the information you provide us with to process your orders and improve our services. All data that we collect is done so lawfully and is maintained in accordance with the Data Protection Act 1998.
9.2 We value your privacy and take it very seriously, so we will not pass on your
details to any third party without your consent, with the exception of where we have to fulfil orders, such as with delivery companies.
9.3 Peckham Cellars may occasionally send you information about promotions or personalised offers on our products, unless you have explicitly told us not to by setting your communication preferences on our registration page or your account settings.
9.4 If you choose not to hear from us or third parties, you will only be contacted by us if our Terms and Conditions change.

10. General

10.1 Peckham Cellars will not be liable for any delay in your wine delivery if the delay or failure to deliver is caused by circumstances out of our control, such as war, civil commotion, fires, floods, malicious damage, riot, compliance with law or governmental ruling or regulations, or failure of ISP or telecommunications providers in connection with this agreement.
10.2 Peckhamcellars.co.uk may change or add to these Terms and Conditions for security, legal or regulatory reasons, however this right to amend these terms will not be used to vary the terms of special offers that apply to you.
10.3 There is no contract between Peckham Cellars and you until you have been notified that we have accepted your order and delivered your items. We are under no obligation to accept your order.

Your use of Peckhamcellars.co.uk, as well as any dispute raised as a result of using the website, is subject to the laws of England, Northern Ireland, Scotland and Wales.
